Terms of Service

These Terms govern your use of bookfellow.io and related Bookfellow services. Our Privacy Policy explains how we handle personal information. Questions: support@bookfellow.io.

1. Agreement to these terms

These Terms of Service (“Terms”) are a legal agreement between you and Bookfellow (“we,” “us,” or “our”) governing your access to and use of bookfellow.io and related products and services (the “Service”).

By visiting the site, joining a waitlist, creating an account, purchasing or unlocking a companion, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Our Privacy Policy explains how we collect and use personal information. If these Terms conflict with a signed written agreement with you, that agreement controls for the conflicting subject.

2. What Bookfellow is

Bookfellow is a companion for books you are reading or listening to. It helps you remember, reflect, and return to titles you already own or are actively consuming. It is not:

  • a substitute for reading or listening to the book itself;
  • a library that replaces buying or borrowing books; or
  • a guarantee that every title, edition, or format is supported.

Companion features may include library views, progress-bounded chat and questions, notes and reflections, quizzes, cast or term sheets, generated guides, and related tools we offer over time. Features available on the public placeholder may be limited (for example, waitlist and eligibility information only) until the full product launches.

3. Eligibility and location

  • You must be at least 13 years old to use the Service. If you are under 18, you may use the Service only with a parent or guardian’s involvement as required by law.
  • Bookfellow is a United States company. The Service is offered to customers in the United States.
  • You are responsible for complying with laws that apply to you where you live.

4. Accounts

When accounts are available:

  • You must provide accurate information and keep it updated.
  • You are responsible for activity under your account and for keeping your credentials secure.
  • Notify us promptly at support@bookfellow.io if you suspect unauthorized access.
  • We may refuse, suspend, or terminate accounts that violate these Terms or that we reasonably believe create risk to users, rights holders, or the Service.

5. Catalog and eligibility

Not every book is supported. We focus on trade fiction and trade nonfiction in English. We may decline titles or classes of works that do not fit our product (for example: textbooks, academic or scientific monographs, comics and graphic novels, unofficial or unpublished material, self-published works without a traditional imprint, reference works, periodicals, workbooks, picture books, and similar categories). We may also park other categories indefinitely.

If we decline a title, we may offer a waitlist or notify you when support expands. Eligibility rules may change; the Service’s current eligibility copy controls for what we accept.

We do not guarantee companion quality for every edition, abridgement, translation, or audiobook production of a title.

6. Unlocking companions; subscriptions and purchases

6.1 Ways to unlock

Depending on what we offer at the time, you may unlock a companion for a title through:

  • a free allotment included with your plan or trial;
  • a subscription allotment;
  • an à-la-carte purchase; and/or
  • a partner or publisher offer (for example, free companion with verified proof of purchase of that book).

Unless we clearly say otherwise, partner offers unlock the companion for that title — not a hosted copy of the full book.

Current prices, allotments, trial details, and plan names are shown on the Service at purchase or sign-up. We may change plans prospectively; changes will not reduce access you already have under Section 7 except as allowed there.

6.2 Billing

Paid features are billed through our payment processor. You authorize us (and the processor) to charge the payment method you provide for the amounts and schedule you select. Taxes may apply. Except where required by law or stated at checkout, fees are non-refundable.

6.3 Cancellation of membership

You may cancel a subscription as described in the Service or by contacting support. After cancel:

  • you lose future allotments and any member-only pricing;
  • you keep companions you already unlocked, subject to Section 7.

7. How long unlocked companions last

This section is intentional product policy, not marketing fluff.

  1. While Bookfellow operates the Service: Once you unlock a companion for a title (allotment, purchase, or qualifying partner offer), you may continue to use that unlocked companion without an active paid membership for as long as we operate Bookfellow as a going service for that product line (“life of the Service”).
  2. If we shut down or discontinue the Service: We will provide a reasonable wind-down period of at least about three (3) months of continued access to previously unlocked companions when practicable, starting from a public notice of discontinuation. That wind-down is a commitment of access duration, not a cash refund, not a transfer of copyright in underlying books, and not a promise of perpetual hosting after the wind-down ends.
  3. What this is not: Unlock permanence is not absolute forever, not a warranty against outages, not a guarantee of identical features forever, and not a license to the full text of copyrighted books.
  4. What cancel does not remove: Canceling membership does not by itself revoke prior unlocks under paragraphs 1–2, except for fraud, chargebacks, material Terms violations, or legal/rights requirements.

We may update features, regenerate companion material, or retire obsolete formats while preserving the substance of your unlock where reasonably possible.

8. Acceptable use

You agree not to:

  • use the Service for any unlawful purpose;
  • attempt to scrape, bulk-download, or redistribute companion packs, generated assets, or other Service content outside normal personal use;
  • reverse engineer, bypass rate limits, or interfere with security or access controls;
  • misuse AI features to harass, defraud, or generate unlawful content;
  • submit content you do not have the right to submit;
  • misrepresent proof of purchase or eligibility for partner offers;
  • use the Service to infringe copyrights, trademarks, or other rights of authors, publishers, or others;
  • access the Service through automated means except as we expressly allow (for example, a published API).

We may investigate and take action (including suspension or termination) for violations.

9. AI-generated and progress-bounded content

Companion material is generated or assisted by automated systems and may contain errors, omissions, or interpretations that differ from the book.

  • Features that are spoiler-safe are designed to respect progress you mark. You are responsible for marking progress honestly if you want that protection.
  • Bookfellow is an aid to memory and reflection — not professional advice (legal, medical, financial, academic, or otherwise).
  • You should not rely on generated answers as a substitute for the book or for expert judgment.

10. Intellectual property

  • Underlying books: Copyrights and other rights in books remain with their authors, publishers, and rights holders. Bookfellow does not claim ownership of those works. Having a companion does not grant you rights to copy or distribute the book.
  • Our Service and companion assets: The Service, software, branding, and generated companion materials we create (guides, quizzes, sheets, images, and similar packs), excluding your User Content, are owned by Bookfellow or its licensors. We grant you a personal, non-exclusive, non-transferable license to use unlocked companions for your own lawful, non-commercial use under these Terms.
  • Trademarks: “Bookfellow,” bookfellow.io, and related marks are ours. You may not use them without permission except to refer accurately to us.

11. Your content

“User Content” means notes, reflections, messages, progress marks, voice or image submissions you choose to provide, and similar material you create in the Service.

  • You retain ownership of your User Content.
  • You grant us a worldwide, non-exclusive license to host, process, display, and use User Content as needed to operate and improve the Service for you (and as described in the Privacy Policy).
  • You represent that you have the rights needed to submit User Content and that it does not violate law or others’ rights.
  • We may remove User Content that violates these Terms or creates legal risk.

Voice and image handling (for example, not retaining raw audio or original photos after processing unless you save them) is described in the Privacy Policy.

12. Third-party services and links

The Service may link to or integrate with third parties (payment processors, publishers, app stores, email providers). Their terms and privacy practices apply to their services. We are not responsible for third-party sites or offers we do not control.

13. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT COMPANION CONTENT WILL BE COMPLETE OR ACCURATE.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS; IN THOSE PLACES, OUR DISCLAIMERS APPLY TO THE FULLEST EXTENT ALLOWED.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOKFELLOW AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US $100).

THESE LIMITS DO NOT APPLY WHERE FORBIDDEN BY LAW (FOR EXAMPLE, LIABILITY FOR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT WHERE SUCH EXCLUSIONS ARE NOT ALLOWED).

15. Indemnity

You will defend and indemnify Bookfellow and its operators against claims, damages, and expenses (including reasonable attorneys’ fees) arising from your User Content, your misuse of the Service, your violation of these Terms, or your infringement of others’ rights — except to the extent caused by our willful misconduct.

16. Suspension and termination

We may suspend or terminate access immediately if you violate these Terms, if required by law or rights holders, or if we discontinue the Service (subject to Section 7 wind-down where applicable). You may stop using the Service at any time. Provisions that by nature should survive (including Sections 7–15 and 17–19) survive termination.

17. Changes to these Terms

We may update these Terms from time to time. We will post the revised version on bookfellow.io with a new “Last updated” date. Material changes may also be communicated by email or in-product notice. Continued use after an update means you accept the revised Terms. If you do not agree, stop using the Service.

18. Governing law and disputes

These Terms are governed by the laws of the State of Texas and the United States, without regard to conflict-of-law rules. Courts in Travis County, Texas will have exclusive jurisdiction over disputes, except that either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property or confidential information.

Informal resolution first: Before filing a claim, email support@bookfellow.io and allow 30 days to try to resolve the dispute informally.

19. General

  • Entire agreement: These Terms plus the Privacy Policy and any plan-specific checkout terms are the entire agreement for the Service, unless a signed agreement says otherwise.
  • Severability: If a provision is unenforceable, the rest remains in effect.
  • No waiver: Failure to enforce a provision is not a waiver.
  • Assignment: You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
  • Notices: We may notify you via the Service, email, or posting on bookfellow.io. You may contact us as below.
